- Last Friday afternoon an update from IRS and Treasury was released to provide guidance for employers and their responsibilities if they elected to provide their employees with the deferred payroll tax for the remainder of 2020. The IRS clarified that it was optional by using the words “can” and not “must” and the employer decides for the entire company and not each employee to participate.

- The payroll tax deferral offered in the Presidential Executive Order signed in late July was set to start on September 1st. The Order requires the deferral to be paid back by April 2021 by the employer (recovering the deductions from the employee). There was discussion that the deferral would be “forgiven”, but it is unlikely that it will be resolved by the end of the year and the repayments of the employee payroll tax referral are currently scheduled to begin in January 2021.
