This session will provide employers with an overview of laws applicable to employee injuries and illness, including the Americans with Disabilities Act (ADA), Family and Medical Leave Act (FMLA), Workers’ Compensation Law (WC) and Families First Coronavirus Response Act (FFCRA). The program will provide strategies and recommendations for responding to employee injuries, requests for modified duty and requests for accommodation.
Topics covered include:
▪ How to prepare for another round of COVID-19 from an ADA, FMLA and FFCRA perspective
▪ Understanding when to trigger ADA, FMLA, WC and FFCRA processes, simultaneously and separately
▪ Having a robust ADA policy and interactive process, including documentation
▪ Follow-up inquiries to medical providers to narrow down the scope of accommodations/evaluate alternate accommodations
▪ Granting temporary accommodations until employees provide information from their doctor
